What is estoppel under Indian Evidence Act? or Write short notes on Estoppel.

Chapter eight is most important chapter under Indian Evidence Act. Chapter eight of Indian Evidence Act covers section 115 to section 117.. The definition of estoppel is given under section 115 of Indian Evidence Act.

According to section 115, estoppel is, When one person has, by his declaration, act or omission, intentionally caused or permitted another person to believe a thing to be true and to act upon such belief, neither he nor his representative shall be allowed, in any suit or proceeding between himself and such person or his representative, to deny the truth of that thing.

Essential conditions are:

1. there must be a person

2. who declares or does act/omission

3. who intentionally caused or permitted another person to believe a thing to be true and to act upon such belief.

4. neither he nor his representative shall be allowed in any suit or procedings between himself and such person or his representatives to deny the truth of that thing.
